Mediators work with both partners. They maintain neutrality, they are non-judgmental, and they ensure confidentiality. They can provide legal information during the process; they can recommend each person obtains independent legal advice on a particular issue before resolution.

Lawyers work with one person; they provide legal advice as to the best outcome for that client. The outcome might clash with the best outcome for the other partner.  Cleints cannot use the same lawyer and do not share legal fees during the negotiations.

Mediation encourages people to work together to achieve a result that meets both their needs.   Each person's interests are identified, and creative solutions are developed.

Scenario #1 - Two clients each retain a lawyer, provide their financial disclosure, and begin negotiations to settle the property, parenting, and support issues. When there is a roadblock, lawyers often recommend lawyer-assisted mediation. The clients then pay additional legal fees to their own lawyer as well as the lawyer/mediator fees. If settlement is reached, and it most often is, the lawyers prepare a final and binding agreement. The alternative is litigation which again increases legal fees.

 

Scenario #2 - Two clients agree to mediate the issues. They gather the standard financial disclosure. They retain control over the process and work together to come apart. The mediator's fees are shared equally. When both spouses are satisfied they have worked out a plan that takes into account the present and the future, their plan is prepared and sent to one lawyer to prepare a binding agtreement. The other person retains a lawyer to provide independent legal advice about the terms of the agreement. final agreement.
